La Santa Hermandad

Abstract

La obra legislativa de los Reyes Católicos y su impulso reformador de las instituciones tiene una de sus mejores expresiones en los Ordenamientos de Madrigal de 1476 y en el establecimiento de la Santa Hermandad. La Hermandad General o Santa Hermandad no fue, como suele creerse, una simple institución policial cuya ineficiencia, además, daría lugar al conocido refrán “a buenas horas mangas verdes”. Muy al contrario, dotada no sólo de un cuerpo armado, sino también de jurisdicción y de tribunales propios que seguían un proceso criminal reglado y sumario, y que estaba facultada para ejecutar sin demora las penas impuestas, incluso la de muerte, y financiada con tributos establecidos al efecto, fue un instrumento decisivo para imponer la autoridad y la justicia real frente a malhechores y banderías, pero sobre todo frente a una nobleza poderosa y remisa a perder sus privilegios señoriales.

The legislative work of the Catholic Monarchs and their drive to reform institutions found one of its best expressions in the Ordenamientos de Madrigal of 1476 and the establishment of the Santa Hermandad. The General Brotherhood or Santa Hermandad was not, as is often believed, a simple police institution whose inefficiency, moreover, would give rise to the well-known saying "a buenas horas mangas verdes". On the contrary, endowed not only with an armed corps, but also with jurisdiction and its own courts which followed a regulated and summary criminal process, and which was empowered to execute without delay the penalties imposed, including death, and financed by taxes established for this purpose, it was a decisive instrument for imposing authority and royal justice against evildoers and bandits, but above all against a powerful nobility reluctant to lose its stately privileges.
