La jurisdicción constitucional en el ámbito mediterráneo : análisis de los tribunales constitucionales de España, Portugal, Francia, Italia y Grecia

Abstract

Se suele decir que existe una cultura homogénea en torno al Mediterráneo y que todos los países en torno a él comparten tradiciones comunes. El fin de este trabajo es comprobar si esta homogenización se comparte también en un ámbito tan importante como es aquel que controla el cumplimiento de los derechos y libertades que se recogen en la Constitución de un país, la jurisdicción constitucional. Dividiremos el trabajo en dos partes, en la primera se compararán cinco tribunales considerados “mediterráneos” (España, Portugal, Francia, Italia y Grecia). Se hará una exposición de su historia, miembros, funciones y estructura utilizando la propia Constitución del país y la ley que la desarrolla. En la segunda parte, y tomando como base la exposición hecha, se analizarán las características expuestas en la primera parte para comprobar si efectivamente existe una jurisdicción común en el ámbito mediterráneo o no. Además, se estudiará la incidencia del Convenio Europeo de Derechos Humanos y el Tribunal Europeo de Derechos Humanos en las jurisdicciones constitucionales europeas.

It is said that there is a common culture in the Mediterranean area and that countries around it share common traditions. The aim of this work is to check if this common culture is also found in such an important field like the one that controls the rights and freedoms hold in a country’s constitution, the constitutional jurisdiction. We will divide the work in two parts, in the first one we will compare five “Mediterranean” courts (Spain, Portugal, France, Italy and Greece). We will expose their history, members, functions and structure using their own Constitution and the law that develop its functioning. In the second part, and from the exposition done in the first part, we will analyse the characteristics of the courts to check if there really is a common constitutional jurisdiction in the Mediterranean or there is not. Besides, we will study the influence of the European Convention on Human Rights and the European Court of Human Right in the European constitutional jurisdictions.
