Las medidas cautelares inaudita parte : claves para una reforma procesal

Abstract

En el presente trabajo se realiza una propuesta de conversión de las medidas cautelares inaudita parte en una tutela sumaria. Para ello, se realiza un recorrido a través de cuatro grandes bloques: concepto y naturaleza jurídica, regulación positiva, presupuestos procesales y derecho de defensa. A lo largo de este recorrido se realiza una interpretación exegética de la Ley de Enjuiciamiento Civil y la Constitución Española, así como un análisis de los principales textos doctrinales y jurisprudenciales sobre la materia. Finalmente, se concluye con una propuesta de tutela sumaria aplicable, mediante una combinación entre la tutela sumaria del artículo 441.2 de la Ley de Enjuiciamiento Civil y la Enmienda 643 presentada en el trámite de aprobación de la Ley de Enjuiciamiento Civil.

This paper proposes turning a Spanish Procedure Institution “medidas cautelares inaudita parte” into a “tutela sumaria”. In order to sustain this change, we will divide our study into four areas: concept and legal nature, positive regulation, procedural requirements and right of defence. Throughout this paper we will use an specific method, an exegetical interpretation both of the Spanish Civil Procedure Act and the Spanish Constitution. Moreover, we will fulfill this paper analyzing the most important rulings and doctrinal articles about “medidas cautelares inaudita parte”. As a result, we propose a change of the Spanish Civil Procedure Act, in order to transform the Spanish “medidas cautelares inaudita parte” into a “tutela sumaria”. This new institution will be made up of the content of the current article 441.2 of the Spanish Civil Procedure Act and the 643th Amendment to the Spanish Civil Procedure Statute.
