Análisis del delito de alzamiento de bienes. Consideración especial de la reforma operada por el proyecto de ley orgánica por la que se reforma el Código Penal

Abstract

El presente trabajo tiene como finalidad analizar, por una parte, la regulación actual del delito de alzamiento de bienes, tipificado en el artículo 257 del Código Penal vigente. Así, estudiaremos los distintos elementos del tipo e igualmente se harán determinadas consideraciones que deben ser particularmente destacadas. Posteriormente, tras conocer la estructura y funcionamiento del tipo, una segunda parte del trabajo consiste en analizar la reforma operada por el Proyecto de Ley Orgánica por la que se modifica la Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal. Nos centraremos así en observar qué cambios introduce la reforma y cuáles son sus consecuencias, dado que este tipo penal se ve afectado por la misma particularmente. Aparte de las reflexiones que se han ido realizando en la segunda parte del trabajo, llegaremos a una conclusión final, donde se expondrá la postura que hemos considerado será la seguida por la jurisprudencia en caso de que finalmente se apruebe el Proyecto citado.

This essay aims to analyze, on the one hand, the present regulation of the crime of concealment of assets, punished by article 257 of the current Spanish Criminal Code. Therefore, we will study the different elements in which the crime is divided. Furthermore, we will make some relevant considerations that must be taken into account when analyzing this crime. On the other hand, after studying the structure and the operation of this penal model, we will analyze the Draft Bill on Reforming Spanish Criminal Code. Thus, we will focus on the changes operated and their consequences, because we will notice the relevant impact of the Draft Bill in this particular crime. Finally, in addition to the thoughts made through the essay, we will finish with a final conclusion, where we will state what will be said by our judges in case of passing the aforementioned Draft Bill.
