Abstract

El derecho de reversión constituye una garantía fundamental en el ámbito de la expropiación forzosa, permitiendo al expropiado o sus causahabientes recuperar el bien cuando desaparece la causa que justificó la privación de la propiedad. Su tratamiento en el sistema registral ha generado controversias, especialmente en lo relativo a su inscripción y oponibilidad frente a terceros adquirentes. Este trabajo analiza el régimen jurídico del derecho de reversión en España, su evolución doctrinal y jurisprudencial, y su relación con los principios registrales de especialidad, tracto sucesivo y fe pública. A partir del estudio de la Resolución de la DGSJFP de 27 de febrero de 2023, se examinan las dificultades de su acceso al Registro de la Propiedad y las implicaciones para la seguridad jurídica y el tráfico inmobiliario.

The right of reversion is a fundamental safeguard in the context of forced expropriation, allowing the expropriated party or their successors to recover the property when the justification for expropriation ceases to exist. Its treatment within the Spanish registration system has sparked debate, particularly regarding its inscription and enforceability against third-party acquirers. This study examines the legal framework of the right of reversion in Spain, its doctrinal and jurisprudential evolution, and its relationship with the principles of specialty, successive chain of title, and registry-based public faith. Through the analysis of the DGSJFP Resolution of February 27, 2023, this research explores the challenges of its registration and the implications for legal certainty and real estate transactions.
