Un análisis crítico del sistema electoral español desde una perspectiva territorial

Abstract

En este trabajo se estudia, desde la perspectiva de Derecho Constitucional, el sistema electoral español. En concreto, el estudio se centrará en las normas electorales fijadas para la composición del Congreso de los Diputados, órgano fundamental en el sistema político español. Para ello, se examinarán los elementos más críticos del sistema electoral, tales como la circunscripción electoral, la barrera electoral y el número de miembros de la cámara. La circunscripción electoral se refiere a la división del territorio en áreas geográficas específicas, cada una de las cuales elige un número determinado de diputados. Este aspecto es crucial, ya que influye directamente en la representación territorial y puede generar desigualdades en la representación de los ciudadanos. La barrera electoral, por otro lado, es el porcentaje mínimo de votos que un partido debe obtener para acceder a la distribución de escaños, lo cual puede afectar la pluralidad y diversidad política en el Congreso. Finalmente, el número de miembros de la cámara determina la capacidad de representación y la dinámica de funcionamiento del órgano legislativo. El estudio se centra en analizar estos puntos para identificar los principales problemas que plantea la regulación actual, especialmente en términos de desproporcionalidad e igualdad en el territorio español. Complementariamente, se analiza el Senado como cámara de representación territorial debido a que el estudio del trabajo se hace desde una perspectiva territorial Se plantearán una serie de alternativas de reformas para paliar estos problemas y, finalmente, el trabajo concluye con las medidas que sería recomendable implementar para mejorar el sistema electoral español, promoviendo así una mayor justicia y equidad en la representación política.

This paper studies the Spanish electoral system from the perspective of Constitutional Law. Specifically, the study will focus on the electoral rules established for the composition of the Congress of Deputies, a fundamental body in the Spanish political system. To this end, the most critical elements of the electoral system will be examined, such as the electoral district, the electoral threshold, and the number of members of the chamber. The electoral district refers to the division of the territory into specific geographical areas, each of which elects a certain number of deputies. This aspect is crucial as it directly influences territorial representation and can generate inequalities in the representation of citizens. The electoral threshold, on the other hand, is the minimum percentage of votes that a party must obtain to access the distribution of seats, which can affect political plurality and diversity in the Congress. Finally, the number of members of the chamber determines the capacity for representation and the dynamics of the legislative body. The study focuses on analyzing these points to identify the main problems posed by the current regulation, especially in terms of disproportionality and equality in the Spanish territory. Additionally, the Senate is analyzed as a chamber of territorial representation, given that the study is conducted from a territorial perspective. A series of reform alternatives will be proposed to address these problems, and finally, the paper concludes with the measures that would be advisable to implement to improve the Spanish electoral system, thus promoting greater justice and equity in political representation.
