El derecho a la educación inclusiva de los niños con discapacidad en el marco constitucional español

Abstract

La educación inclusiva, juega un papel fundamental en la construcción de una sociedad más justa y equitativa, pero ¿hasta qué punto el marco normativo y jurisprudencial garantiza la aplicación real de este derecho fundamental? Este Trabajo de Fin de Grado invita al lector a descubrir los fundamentos teóricos y normativos de la educación inclusiva y su evolución histórica en el derecho internacional y español. A través del análisis de hitos normativos y sentencias judiciales, este trabajo ayuda a entender y comprender el marco jurídico de los derechos de los niños y niñas y estudiantes con discapacidad. La inclusión educativa de personas con discapacidad no solo es un reto social, sino una oportunidad para construir una sociedad más equitativa, diversa y sostenible.

Inclusive education plays a fundamental role in building a fairer and more equitable society, but to what extent does the legal and jurisprudential framework truly guarantee the effective application of this fundamental right? This Final Degree Project invites the reader to explore the theoretical and legal foundations of inclusive education and its historical evolution in both international and Spanish law. Through the analysis of key legal milestones and judicial rulings, this study provides a deeper understanding of the legal framework surrounding the rights of children and students with disabilities. Ensuring inclusive education for people with disabilities is not just a social challenge but also an opportunity to build a more equitable, diverse, and sustainable society.
