Impacto de las reformas legales en curso en el sector del transporte de mercancías por carretera: reducción de la jornada máxima legal, control y registro del tiempo de trabajo y desconexión

Abstract

Este trabajo analiza el impacto de la reforma de la jornada laboral de 2025 en la regulación del tiempo de trabajo en el sector del transporte de mercancías por carretera en España, centrándose en tres aspectos clave: la reducción de la jornada máxima legal, el refuerzo del control del tiempo de trabajo y la desconexión digital. La reforma introduce cambios sustanciales en la gestión operativa de las empresas, afectando a la planificación de turnos y retribución salarial para el cumplimiento normativo. Se estudia en detalle la adaptación del convenio colectivo del transporte de mercancías por carretera en la Comunidad Valenciana al nuevo marco normativo, analizando cómo las empresas deberán ajustarse a la reducción del tiempo de trabajo efectivo sin comprometer la operatividad. Asimismo, se examinan las implicaciones económicas derivadas del incremento del coste salarial por hora trabajada, el ajuste de los complementos salariales y el impacto en la retribución de horas extraordinarias. Desde una perspectiva organizativa, el refuerzo del control horario y la obligación de garantizar la desconexión digital imponen nuevas exigencias administrativas a las empresas, reduciendo su flexibilidad y aumentando sus costes operativos. En términos financieros, se estima que la reforma supondrá un incremento sustancial en la masa salarial, afectando la competitividad del sector y obligando a las empresas a implementar mecanismos de optimización para reducir su impacto.

This paper analyses the impact of the 2025 working time reform on the regulation of working time in the Spanish road freight transport sector, focusing on three key aspects: the reduction of the maximum legal working day, the reinforcement of working time control and digital disconnection. The reform introduces substantial changes in the operational management of companies, affecting shift planning and pay for regulatory compliance. The adaptation of the collective agreement for road freight transport in the Valencian Community to the new regulatory framework is studied in detail, analyzing how companies will have to adjust to the reduction in effective working time without compromising operability. It also examines the economic implications of the increase in the cost of wages per hour worked, the adjustment of wage supplements and the impact on overtime pay. From an organizational perspective, the reinforcement of time control and the obligation to ensure digital disconnection impose new administrative requirements on companies, reducing their flexibility and increasing their operating costs. In financial terms, it is estimated that the reform will lead to a substantial increase in the wage bill, affecting the competitiveness of the sector and forcing companies to implement optimization mechanisms to reduce its impact.
