IMPACTO DE LA INTELIGENCIA ARTIFICIAL EN EL DERECHO. ¿Peligro u oportunidad?

Abstract

Este Trabajo de Fin de Grado examina la compleja interrelación entre la inteligencia artificial y el ordenamiento jurídico, analizando los riesgos y oportunidades que estas tecnologías representan para el sistema judicial. La investigación contextualiza la evolución de la IA desde sus fundamentos hasta su acelerado desarrollo en la Revolución 4.0, destacando el impacto de innovaciones como ChatGPT. El estudio profundiza en aplicaciones concretas de la IA en el ámbito judicial: la automatización en la gestión de expedientes, sistemas predictivos como Jurimetría y vLex Analytics para la toma de decisiones, y herramientas para Mecanismos Alternativos de Solución de Controversias. Se analiza el fenómeno de los "jueces robots", evaluando experiencias internacionales y limitaciones del razonamiento artificial frente al judicial humano, junto con los desafíos para el futuro del empleo jurídico. La investigación examina el marco regulatorio emergente, con énfasis en el Reglamento Europeo de IA (UE) 2024/1689 y su paradigma basado en niveles de riesgo. Se analiza la aproximación europea como "tercera vía" que prioriza la protección de derechos fundamentales, y la creación de la Agencia Española de Supervisión de Inteligencia Artificial. Finalmente, se aborda la problemática ética de la IA jurídica y se concluye que la respuesta a la pregunta "¿Peligro u oportunidad?" trasciende dicotomías simplistas. La verdadera cuestión no es si debemos implementar estas tecnologías, sino cómo hacerlo preservando valores esenciales de justicia y dignidad humana. El éxito de la IA jurídica debe medirse no solo por indicadores de eficiencia, sino por su capacidad para fortalecer, nunca debilitar, los principios fundamentales del ordenamiento jurídico.

This Final Degree Project examines the complex interrelationship between artificial intelligence and the legal system, analyzing the risks and opportunities that these technologies represent for the judicial system. The research contextualizes the evolution of AI from its foundations to its accelerated development in the 4.0 Revolution, highlighting the impact of innovations such as ChatGPT. The study delves into concrete applications of AI in the judicial field: automation in case management, predictive systems such as Jurimetry and vLex Analytics for decision making, and tools for Alternative Dispute Resolution Mechanisms. The phenomenon of "robot judges" is analyzed, evaluating international experiences and limitations of artificial reasoning compared to human judicial reasoning, along with the challenges for the future of legal employment. The research examines the emerging regulatory framework, with emphasis on the European AI Regulation (EU) 2024/1689 and its paradigm based on risk levels. The European approach is analyzed as a "third way" that prioritizes the protection of fundamental rights, and the creation of the Spanish Agency for the Supervision of Artificial Intelligence. Finally, the ethical problems of legal AI are addressed and it is concluded that the answer to the question "Danger or opportunity?" transcends simplistic dichotomies. The real question is not whether we should implement these technologies, but how to do so while preserving essential values of justice and human dignity. The success of legal AI should be measured not only by efficiency indicators, but by its ability to strengthen, never weaken, the fundamental principles of the legal system.
