Judicial diplomacy: a comparative analysis of the conduct of International and National Courts.

Abstract

El TFG analiza la diplomacia judicial como el conjunto de prácticas institucionales realizadas por tribunales fuera de su función decisoria, con el fin de relacionarse con audiencias extranjeras, reforzar su legitimidad y aumentar su influencia. El estudio parte de la premisa que el poder judicial puede proyectarse internacionalmente, convirtiéndose en un actor relevante en la sociedad internacional. El trabajo intenta responder a la pregunta de por qué el comportamiento de los tribunales respecto a la diplomacia judicial es distinto si se trata de tribunales nacionales o internacionales. Por ello, se ve como ambas partes comparten ciertas prácticas, pero sus objetivos y condicionantes estructurales no son los mismos, debido a su fuente de autoridad y posición en el sistema internacional. Todo esto concluye con que la diplomacia judicial es una herramienta de poder blando jurídico, pero respondiendo a diferentes finalidades.

The thesis analyzes judicial diplomacy as the set of institutional practices carried out by courts outside their adjudicative function, with the aim of engaging with foreign audiences, strengthening their legitimacy, and increasing their influence. The study starts from the premise that the judiciary can project itself internationally, thus becoming a relevant actor in international society. The work seeks to answer the question of why courts behave differently with regard to judicial diplomacy depending on whether they are national or international courts. To this end, it shows that, although both types share certain practices, their objectives and structural constraints are not the same, due to their source of authority and their position within the international system. All of this leads to the conclusion that judicial diplomacy is a tool of legal soft power, but one that serves different purposes.
