A partir del estudio de su fundamento jurídico y de su relación con el Convenio de Nueva York de 1958, se examina la evolución de la jurisprudencia del Tribunal en sentencias como Nordsee, Marc Rich, Van Uden, West Tankers, Gazprom y Prestige. El análisis permite valorar cómo se ha delimitado el alcance de esta exclusión y reflexionar sobre el equilibrio entre la autonomía del arbitraje internacional y la coherencia del sistema judicial europeo. This Final Degree Project analyses the exclusion of arbitration from the scope of Regulation (EU) No. 1215/2012 (Brussels I bis) and its interpretation by the Court of Justice of the European Union. Based on the study of its legal foundations and its relationship with the 1958 New York Convention, the paper examines the evolution of the Court’s case law in decisions such as Nordsee, Marc Rich, Van Uden, West Tankers, Gazprom and Prestige.
