Para ello, se estudia el marco normativo internacional, europeo y nacional aplicable, así como los principios rectores del Derecho penal de menores, con especial atención al interés superior del menor. El trabajo examina las garantías en la obtención del testimonio, la regulación de la prueba preconstituida y los mecanismos destinados a evitar la victimización secundaria, junto con el valor probatorio de la declaración del menor según la jurisprudencia. Asimismo, se aborda el papel del Ministerio Fiscal y los principales problemas prácticos del sistema, destacando la necesidad de avanzar hacia un modelo más especializado y adaptado a la vulnerabilidad del menor. This Final Degree Project analyses the legal protection of minors within the Spanish criminal process, focusing on their role as victims or witnesses, and particularly on the taking of their statements. To this end, it examines the applicable international, European and national legal framework, as well as the guiding principles of juvenile criminal law, with special attention to the best interests of the minor. The study addresses the safeguards surrounding the obtaining of testimony, the regulation of pre-constituted evidence, and the mechanisms aimed at preventing secondary victimisation, together with the evidentiary value of minors’ statements according to case law.
