Partiendo del modelo prohibicionista vigente en España, el estudio examina el marco normativo, la jurisprudencia nacional y europea y los distintos modelos internacionales, poniendo especial atención en los conflictos entre dignidad humana, integridad de la mujer gestante y derechos del menor. El trabajo destaca la colisión entre los intereses de la gestante, los progenitores intencionales y el interés superior del menor, concluyendo que no se trata de derechos equivalentes, sino de posiciones con distinta protección constitucional. Asimismo, subraya que la práctica genera tensiones difíciles de resolver, especialmente en contextos internacionales. Como conclusión, sostiene que la gestación subrogada es difícilmente compatible con los principios constitucionales, defendiendo el mantenimiento, e incluso refuerzo, del modelo prohibicionista, priorizando la protección del menor sin legitimar la práctica Surrogacy is analyzed from a constitutional and legal perspective in order to determine whether it is compatible with the Spanish legal system or whether its prohibition responds to structural requirements of fundamental rights. Starting from the prohibitionist model currently in force in Spain, the study examines the legal framework, national and European case law, and different international models, with particular attention to the conflicts between human dignity, the physical and moral integrity of the gestational mother, and the rights of the child. The work highlights the clash between the interests of the gestational mother, the intended parents, and the best interests of the child, concluding that these are not equivalent rights but positions with different levels of constitutional protection. It also emphasizes that the practice generates tensions that are difficult to resolve, especially in international contexts.
