El bloqueo del Consejo General del Poder Judicial: implicaciones constitucionales para la separación de poderes en España

Abstract

El presente Trabajo de Fin de Grado analiza el bloqueo en la renovación del Consejo General del Poder Judicial (CGPJ) en España durante el periodo 2018-2024, desde una perspectiva jurídico-constitucional. El estudio parte del examen del marco normativo que regula este órgano, así como de su papel esencial en la garantía de la independencia judicial y en el equilibrio entre los poderes del Estado. A partir de ello, se reconstruye el desarrollo de la crisis institucional, identificando sus causas principales en la polarización política y en las deficiencias estructurales del sistema de elección parlamentaria de sus vocales.

El trabajo evalúa las consecuencias del bloqueo tanto en el plano institucional como en el funcional, destacando su impacto en la legitimidad democrática del órgano, el funcionamiento del Tribunal Supremo y la percepción social de la justicia. Asimismo, se analiza la respuesta ofrecida por el Tribunal Constitucional y el papel desempeñado por las instituciones europeas, en particular la Comisión Europea y la Comisión de Venecia, cuya intervención resultó determinante para la resolución del conflicto.

Finalmente, el estudio aborda las posibles vías de reforma del sistema de elección del CGPJ, valorando las distintas propuestas doctrinales y su adecuación a los estándares europeos de independencia judicial. Se concluye que la crisis ha puesto de manifiesto la necesidad de introducir mecanismos que eviten el bloqueo institucional y refuercen la autonomía del Poder Judicial, consolidando así el Estado de Derecho en España.

This Final Degree Project examines the deadlock in the renewal of the General Council of the Judiciary (CGPJ) in Spain between 2018 and 2024 from a constitutional and legal perspective. The study begins with an analysis of the regulatory framework governing this institution, as well as its essential role in safeguarding judicial independence and maintaining the balance of powers within the State. It then reconstructs the development of the institutional crisis, identifying its main causes in political polarization and in the structural weaknesses of the parliamentary appointment system of its members.

The paper assesses the consequences of the deadlock at both institutional and functional levels, highlighting its impact on the democratic legitimacy of the body, the functioning of the Supreme Court, and public trust in the justice system. It also examines the response provided by the Constitutional Court and the role played by European institutions, particularly the European Commission and the Venice Commission, whose intervention proved decisive in resolving the crisis.

Finally, the study explores possible reforms of the CGPJ appointment system, evaluating different doctrinal proposals and their compliance with European standards on judicial independence. It concludes that the crisis has revealed the need to introduce mechanisms to prevent institutional deadlock and to strengthen judicial autonomy, thereby reinforcing the rule of law in Spain.
