Experiencias de derecho comparado en la gestión privada de servicios públicos sanitarios : lecciones del Reino Unido, con especial énfasis en Escocia
Abstract
Esta investigación de derecho comparado analiza experiencias del Reino Unido, con especial énfasis en Escocia, en materia de colaboración público-privada en el ámbito sanitario. Partiendo de un marco conceptual en el que se delinean las bases teóricas e históricas de la materia prestando especial atención a las distintas ramas del Derecho implicadas, llega la investigación a una enumeración de puntos conflictivos de la colaboración público-privada en el ámbito sanitario, basada en debates parlamentarios. Esta base es entonces empleada para estructurar el análisis de varias experiencias del Reino Unido (LIFT, la New Royal Infirmary de Edimburgo, SOPC, NPD, y el Code of conduct for operational PFI/PPP), de las que surgen lecciones relevantes para el caso español en materias concretas como la inversión en infraestructuras de atención primaria, la simplificación del proceso de contratación, o la combinación de flexibilidad y equilibrio contractual. This comparative law research analyzes UK experiences, with a special emphasis on Scotland, on public-private partnerships in the health field. Starting from a conceptual framework in which the theoretical and historical bases of the matter are delineated paying special attention to the different law branches involved, the investigation arrives at an enumeration of conflictive points of public-private collaboration in the health field, based in parliamentary debates. This basis is then used to structure the analysis of various UK experiences (LIFT, New Royal Infirmary of Edinburgh, SOPC, NPD, and Code of conduct for operational PFI/PPP), from which relevant lessons emerge for the Spanish case in specific matters such as investment in primary care infrastructures, simplification of the contracting process, or the combination of flexibility and contractual balance.
