Dicho examen del concepto de igualdad se basará en el estudio, primeramente, del texto constitucional de ambos territorios. Seguidamente, se analizará toda la legislación aplicable con relación al derecho a la igualdad, y la acción y discriminación positiva. Asimismo, con el fin de complementar dicho estudio del marco legislativo, y a su vez esclarecer su comprensión, se hará un recorrido por todas las decisiones jurisprudenciales emitidas por el Tribunal Constitucional en el caso español y por el Tribunal Supremo de los Estados Unidos en el caso estadounidense. La doctrina jurisprudencial establecida por ambos tribunales recoge todos los criterios y límites consideradas e implantadas por los tribunales para las nociones de igualdad, derecho a la igualdad, discriminación y acción positiva. Por otro lado, el contexto histórico y social de cada nación jugará un papel fundamental, ilustrando el proceso legislativo de cada país sucintamente y cómo ambos, en diferentes momentos de la Historia, alcanzan la codificación de la igualdad como derecho. A modo de conclusión, se realizará un examen comparativo de ambos modelos donde se profundizará en los puntos de divergencia y en los asuntos en que ambos modelos coinciden, argumentando las posibles razones en las que se basan dichas diferencias. This Final Thesis focuses on the analysis of the notion of equality and the understanding and interpretation of the term affirmative action in Spain and in the United States of America. This examination of the concept of equality will be firstly based on the evaluation of the constitutional provisions of both territories. Secondly, all applicable legislation on the matter of equality and affirmative action will be subject to study. Furthermore, so as to complement the aforementioned analysis of the legislative framework and further clarify it, we will proceed to the consideration of all the jurisprudential decisions emitted by the Constitutional Court in the Spanish context and the Supreme Court of the United States in the United States’ section. The jurisprudential doctrine established by both courts of law codifies all the relevant criteria and limits weighed and enforced on the subject of equality and affirmative action. On the other hand, we will also compare the sociological and historical background that has shaped both nations. This comparative analysis will be paramount to illustrate briefly the legislative process followed in each territory and how both, at different moments in time, have achieved the codification of equality as a right.
