LA RESPONSABILIDAD CIVIL EN EL ÁMBITO DE LOS DAÑOS CATASTRÓFICOS

Abstract

El presente trabajo tiene por objeto estudiar el régimen jurídico aplicable a la reparación de daños catastróficos, prestando especial atención a la responsabilidad civil y a los mecanismos complementarios que operan en este ámbito. En particular, se examinará la interacción entre la responsabilidad civil, el contrato de seguro, el sistema de cobertura extraordinario articulado a través del Consorcio de Compensación de Seguros y las ayudas públicas extraordinarias, así como los límites y posibilidades de cada uno de estos instrumentos dentro del modelo español de resarcimiento. Atendiendo a su funcionamiento conjunto ante supuestos en los que la magnitud del daño, la pluralidad de perjudicados y la dificultad de identificar un responsable único obligan a diseñar respuestas jurídicas complejas y escalonadas. El estudio se apoyará en las principales construcciones doctrinales del Derecho Civil, el Derecho de Daños y el Derecho de Seguros, y se completará con la jurisprudencia más significativa, con el fin de proporcionar un enfoque no solo teórico, sino también práctico y conectado con la realidad, permitiendo valorar de forma crítica la suficiencia del sistema vigente y su capacidad para ofrecer una reparación adecuada, eficaz y coordinada frente a las consecuencias derivadas de fenómenos catastróficos.

The purpose of this dissertation is to examine the legal framework applicable to the compensation of catastrophic damage, with particular attention to civil liability and the complementary mechanisms operating in this field. In particular, it will analyse the interaction between civil liability, the insurance contract, the extraordinary coverage system implemented through the Insurance Compensation Consortium, and extraordinary public aid, as well as the limits and potential of each of these instruments within the Spanish compensation model. Particular consideration will be given to their joint operation in situations where the scale of the damage, the plurality of injured parties, and the difficulty of identifying a single liable party make it necessary to design complex and layered legal responses. The study will be based on the main doctrinal constructions of Civil Law, Tort Law, and Insurance Law, and will be complemented by the most significant case law, with the aim of providing an approach that is not only theoretical, but also practical and closely connected to reality, thereby allowing for a critical assessment of the adequacy of the current system and its capacity to provide proper, effective, and coordinated compensation for the consequences arising from catastrophic events.
