A partir de lo establecido en los artículos 806 a 822 del Código Civil, se abordan los principales focos de conflicto: cómo se determina el caudal hereditario, el cálculo de las legítimas, el impacto de donaciones y disposiciones testamentarias, y figuras relacionadas como la preterición, la cautela Socini o la reducción de donaciones inoficiosas. También se examina el papel del notario en la prevención de litigios, así como la jurisprudencia reciente del Tribunal Supremo en temas como la desheredación o las donaciones colacionables. El estudio concluye que, aunque la legítima cumple una función protectora, sigue generando tensiones entre la libertad del testador y los derechos de los herederos forzosos. Esto pone de relieve la necesidad de una reforma normativa del régimen de la legítima This study examines the institution of the forced share (legítima) within Spanish Inheritance Law and the practical issues raised in notarial and judicial practice. Based on the rules contained in Articles 806 to 822 of the Spanish Civil Code, the work addresses the main areas of conflict: the determination of the hereditary estate (caudal hereditario), the calculation of compulsory shares, the impact of inter vivos donations (donaciones inter vivos) and testamentary dispositions, and related figures such as preterition (preterición), the Socini clause (cautela Socini), and the reduction of excessive donations (donaciones inoficiosas). The study also analyses the role of the notary in preventing disputes, as well as recent case law from the Spanish Supreme Court concerning matters such as disinheritance and donations subject to collation (donaciones colacionables). It concludes that, although the forced share serves a protective function, it continues to generate tension between the testator’s freedom of disposition and the rights of the forced heirs.
