Las Brujas de Zugarramundi: análisis jurídico de un proceso inquisitorial

Abstract

Este Trabajo de Fin de Grado tiene por objeto realizar un análisis jurídico del proceso inquisitorial seguido contra las llamadas “Brujas de Zugarramurdi”, cuyo punto culminante fue el Auto de Fe de Logroño de 1610. Se estudia el funcionamiento del procedimiento inquisitorial a partir de documentos primarios y secundarios, fundamentalmente de naturaleza jurídica para permitir una correcta interpretación procesal de lo ocurrido, y complementados con fuentes de carácter histórico que ayudan a contextualizar el ambiente cultural de la época. Sobre esta base, se tratan las fases del procedimiento, las pruebas, la tipificación del delito de brujería y la estructura jurisdiccional del Santo Oficio. El objetivo es comprender cómo operó jurídicamente la Inquisición en este caso concreto, evaluando tanto su marco normativo como la construcción jurídica del delito, la validez procesal de las pruebas presentadas y la decisión tomada por las autoridades de la época.

This Final Degree Project seeks to provide a legal analysis of the inquisitorial proceedings brought against the so-called “Witches of Zugarramurdi,” culminating in the Auto de Fe of Logroño in 1610. It examines how the inquisitorial procedure functioned through the study of primary and secondary sources, mainly legal in nature, to allow for an accurate procedural interpretation of the events, while also drawing on historical sources that help to contextualize the cultural climate of the period. On this basis, the study explores the different stages of the proceedings, the evidence submitted, the legal classification of witchcraft as an offence, and the jurisdictional structure of the Holy Office. Its aim is to understand how the Inquisition operated from a legal perspective in this particular case, assessing both the normative framework within which it acted and the legal construction of the offence, as well as the procedural validity of the evidence and the decision ultimately adopted by the authorities of the time.
