El delito de "online child grooming" del art. 183.ter del Código Penal español
Resumen
El presente trabajo se propone llevar a cabo un estudio sobre la controvertida creación
de un nuevo delito contra la libertad e indemnidad sexual de los menores de 16 años con
la reforma penal de 2010, introducido por el art.183.bis. La figura delictiva en cuestión,
cuya denominación más extendida en el ámbito internacional es la de online child
grooming, ocupa actualmente el art.183.ter.1º a raíz de la reciente reforma operada por
la LO 1/2015, de 30 de marzo, y constituye el tema central de la presente investigación,
que abordará, en primer lugar, cuáles fueron las razones que motivaron al legislador
penal español a su incriminación. Seguidamente, se procederá a realizar un análisis
pormenorizado de su estructura típica, abordando las diferentes problemáticas que su
configuración plantea así como las diversas posturas doctrinales existentes al respecto,
en un intento de sentar las bases para una adecuada interpretación de este novedoso
delito, no exento de críticas. The main aim of this paper is to carry out a study on the controversial introduction with
the reform of the Spanish criminal code in 2010 of a new sexual offence against
children under 16 years old, regulated by the art.183.bis. This criminal figure, most
commonly known in the international scene under the denomination of online child
grooming is currently regulated by the art.183.ter.1º since the recent reform operated
by the LO 1/2015, and will be the main topic discussed in this paper. Firstly, the
reasons that motivated the incrimination of this figure by the Spanish legislator will be
adressed. Such study will be followed by a detailed analysis of the structure of the
offence, attending the different problems generated by its configuration, as well as the
different existing doctrinal postures, in an attempt to lay the foundations for an
adequate interpretation of this newly created offence.
