Abstract

El capítulo estudia la relación entre el concepto constitucional de persona y el derecho a la vida, a partir del artículo 15 de la Constitución española de 1978. Durante los debates parlamentarios se discutió si debía emplearse el término “todos” o “la persona” como sujeto de este derecho. La opción por “todos” buscaba incluir al nasciturus en la protección constitucional, evitando interpretaciones que legitimaran el aborto. En cambio, la referencia a “la persona” podía dejar espacio para su despenalización. El Código Civil vigente entonces vinculaba la personalidad al nacimiento, aunque reconocía ciertos efectos favorables al concebido, siempre que llegara a nacer con vida durante 24 horas. Esta formulación suscitó controversias sobre la protección jurídica del no nacido. Finalmente, se adoptó “todos”, aunque la interpretación quedó abierta y condicionada por la correlación política y las decisiones del Tribunal Constitucional. En 1985, dicho tribunal declaró constitucionales tres supuestos de despenalización del aborto, obligando a ajustar el Código Penal. El autor concluye que no conviene forzar un concepto constitucional distinto al civil, sino reconocer la realidad ontológica de la persona como fundamento del derecho, evitando construcciones parciales que puedan legitimar privar de la vida a inocentes.

The chapter examines the relationship between the constitutional concept of personhood and the right to life, focusing on Article 15 of the 1978 Spanish Constitution. During parliamentary debates, legislators discussed whether the subject should be defined as “everyone” or “the person.” The choice of “everyone” aimed to include the unborn (nasciturus) within constitutional protection, thereby preventing interpretations that might justify abortion. By contrast, “the person” left room for its potential decriminalization. At that time, the Spanish Civil Code linked legal personality to birth, though it granted certain rights to the conceived child, provided it was born alive and survived 24 hours. This framework fueled controversy about the legal status of the unborn. Ultimately, “everyone” was adopted, but its meaning remained open to interpretation and subject to political power and constitutional adjudication. In 1985, the Constitutional Court upheld the constitutionality of three circumstances allowing abortion, which led to reforms in the Penal Code. The author concludes that constructing an artificial constitutional definition of personhood is misguided; instead, the law should reflect the ontological reality of the person as the foundation of all rights, avoiding partial interpretations that could legitimize depriving innocents of life.
