"La crítica iusfilosófica de Carl Schmitt a la democracia liberal: Reflexiones en torno a su vigencia".

Abstract

El presente trabajo examina la figura de Carl Schmitt atendiendo tanto a su trayectoria vital como al contexto histórico e intelectual que nutre su pensamiento. Ello se realizará a través del estudio de sus conceptos fundamentales, como lo son, soberanía, decisión, representación y excepción, y en especial su crítica a la democracia liberal acompañada de su concepto de lo político, pues se busca comprender el alcance y sentido de su impugnación al modelo liberal de legitimidad política. Conforme a ello, se analiza la vigencia contemporánea de dicha crítica, valorando si se dan, entre otros aspectos, medidas que puedan dar lugar a un fortalecimiento de la crítica o de aquello que se critica, siendo por ejemplo estas, el aumento del poder punitivo estatal, el análisis de si se da un deterioro de ciertos derechos y libertades, la posibilidad de que existan ciertos ciudadanos que puedan dejar de ser tratados como tal, etc. Todo ello, con la intención de evidenciar si el pensamiento de Carl Schmitt permanece a la orden del día o dista de la realidad contemporánea.

The present thesis examines the figure of Carl Schmitt, attending both to his life trajectory and to the historical and intellectual context that shaped his thought. This will be carried out through the study of his fundamental concepts, such as, sovereignty, decision, representation and exception, and, in particular, his critique of liberal democracy accompanied by his concept of the political, or as Schwab calls it, the criterion of politics, seeking to understand the scope and meaning of his challenge to the liberal model of political legitimacy. Accordingly, the contemporary relevance of this critique is analysed, assessing whether measures exist that may strengthen what is being criticised, such as the increase of state punitive power, the deterioration of certain rights and freedoms, or the possibility that certain citizens may cease to be treated as such. All of this with the aim of determining whether the thought of Carl Schmitt remains relevant today or falls short of contemporary reality.
