Los Derechos humanos en la Política migratoria de la Unión Europea

Abstract

Con motivo de la reciente crisis migratoria, vivida en Oriente Medio como consecuencia principalmente de la Guerra de Siria, se llevará a cabo un estudio sobre el panorama de los Derechos Humanos en la Unión Europea. Puesto que son muchas las noticias y reportajes que se pueden leer hoy en día sobre la situación precaria y muchas veces inhumana en la que viven en su día a día millones de personas que han abandonado sus hogares por diferentes motivos, en este trabajo se propone la identificación de las obligaciones que tiene que respetar la UE a consecuencia de sus compromisos internos e internacionales. Son muchos los problemas que se han originado en la UE con motivo de la llegada de los solicitantes de asilo y también son muchas y variadas las respuestas que se han dado. Si bien es verdad que con respecto a la civilización occidental, la UE es todo un ejemplo de recepción de solicitantes de asilo, no deja de ser cierto que hay muchos procesos y actuaciones que vulneran la legislación sobre DDHH y que podrían ser mejorados. Es la finalidad de este trabajo pues, analizar los compromisos, resaltar las deficiencias con relación a tales obligaciones y por último proponer soluciones y mejoras al sistema actual para evitar que se produzcan violaciones de los DDHH.

Regarding the recent migratory crisis which has been originated mainly as a consequence of the Syrian war, the aim of this paper is to carry out an investigation about the situation of Human Rights in the European Union. Given the huge amount of news and reports that have been recently published related to the precarious and sometimes inhumane situations that millions of people that abandoned their homes go through, this paper aims to identify the commitments and obligations that the EU has originated internally and internationally and confirm or deny that information. Many are the problems that have been caused in the EU due to the arrival of so many asylum seekers and various are also the responses that the EU has given. Even though the EU is setting an example among most of the western countries, it is still true that many actions and internal procedures don’t respect the Human Rights and that respect towards them could be improved. For those reasons, the objective pursued in this paper is to analyze the commitments, highlight the breaches in relation to those obligations and finally, to sort out or propose different solutions and improvements in order to avoid Human Rights violations.
