Protección del tercero en los artículos 32 y 34 de la Ley Hipotecaria
Resumen
En el presente trabajo se estudia la protección del tercero que regulan los
artículos 32 y 34 de la Ley Hipotecaria. Primeramente realizo una exposición del
concepto de Derecho Hipotecario así como sus antecedentes y principios, que nos
ayudarán a comprender el funcionamiento del actual sistema hipotecario.
A continuación, detallo el debate sobre esta cuestión, en el que son partícipes la doctrina
y la jurisprudencia. Surgen así las tesis monista y dualista que tratan de explicar la
noción de tercero hipotecario y sus bases legales.
Finalmente, se expondrán una serie de aportaciones doctrinales y jurisprudenciales que
se han introducido en los últimos años y que podrán servir para aclarar la polémica que
se viene arrastrando desde la Ley Hipotecaria de 1861. This paper provides a study on the third party in good faith included in the
articles 32 and 34 of the Mortgage Act. It begins with a Mortgage Law statement as
well as its precedents and principles. This will help to gain a better understanding of the
current mortgage system.
Then, the third party in good faith concept discussion is opened. Various doctrinal and
jurisprudential positions will be explained. This positions led to two different theories
so-called monism and dualisim that give different third party in good faith concepts and
varied about the protection requirements.
Finally, current doctrinal and jurisprudential contributions will be stated. They might
help to clarify the controversy that has been carried over since the 1861 Mortgage Act.
