Using a comparative methodology, the article studies how the principle operates in the United States, the United Kingdom, Germany, and Argentina, highlighting convergences and divergences between common law and civil law traditions. Particular attention is given to the difficulties posed by the prosecution of international crimes and serious human rights violations in transitional justice contexts. The author concludes that, although the principle is universally recognized, its practical scope varies according to constitutional structure, legal history, and the tension between legal certainty and retrospective justice.</dim:field>
