¿Puede el derecho salvar a Galileo? Una reflexión constitucional sobre ciencia y anticientifismo

Abstract

El libro analiza la relación entre Derecho constitucional y ciencia en el contexto contemporáneo, centrándose especialmente en el fenómeno del anticientifismo y sus implicaciones para las democracias liberales. A partir del impacto de la pandemia de la COVID-19, el autor examina cómo el negacionismo científico y la desinformación afectan a la toma de decisiones públicas y al consenso democrático. La obra se estructura en dos partes: la primera aborda el anticientifismo, sus causas, manifestaciones y posibles respuestas jurídicas, incluyendo la limitación del discurso anticientífico y la promoción de la alfabetización científica; la segunda estudia el papel de la ciencia en la elaboración normativa, destacando el asesoramiento científico al legislador y el principio de precaución. El trabajo propone fortalecer los mecanismos institucionales que integran evidencia científica en el Derecho para mejorar la calidad democrática.

This book examines the relationship between constitutional law and science in the contemporary context, focusing particularly on the phenomenon of anti-scientific discourse and its implications for liberal democracies. Drawing on the impact of the COVID-19 pandemic, the author analyzes how scientific denialism and misinformation affect public decision-making and democratic consensus. The work is divided into two parts: the first explores anti-scientific movements, their causes, manifestations, and possible legal responses, including limits on anti-scientific speech and the promotion of scientific literacy; the second studies the role of science in lawmaking, highlighting scientific advice to legislators and the precautionary principle. The book advocates strengthening institutional mechanisms that integrate scientific evidence into law to improve democratic governance.
