Abstract

El capítulo aborda la autoría en Derecho penal como categoría central para atribuir responsabilidad por la realización del delito. Examina los criterios que permiten diferenciar al autor de otros intervinientes, atendiendo a la ejecución del hecho, el dominio de la acción y la relevancia jurídico-penal de la conducta. También sitúa la autoría dentro de la teoría jurídica del delito y la conecta con cuestiones próximas, como la coautoría, la autoría mediata y la delimitación frente a la participación criminal. Su enfoque es sistemático y orientado a explicar cómo se identifica al sujeto penalmente responsable cuando intervienen una o varias personas en el hecho delictivo. El tratamiento resulta útil para comprender los fundamentos dogmáticos y prácticos de la imputación personal en el Derecho penal español.

The chapter examines authorship in criminal law as a core category for attributing responsibility for the commission of an offence. It analyses the criteria used to distinguish the perpetrator from other participants, with attention to the execution of the act, control over the conduct, and the legal significance of the behaviour. It also places authorship within the broader theory of crime and connects it with related issues such as co-authorship, indirect perpetration, and the distinction between authorship and criminal participation. The approach is systematic and aimed at explaining how the legally responsible subject is identified when one or several persons are involved in the criminal act. The chapter is useful for understanding the doctrinal and practical foundations of personal attribution in Spanish criminal law.
