En concreto, se discuten los límites que tiene la parte empresarial para comunicarse de manera directa y por decisión unilateral con sus trabajadores, es decir, si cualquier reunión de este calibre es susceptible de ser considerada un acto lesivo del derecho a la libertad sindical. Para ello se procederá a hacer una ponderación de derechos entre, por un lado, el ya mencionado derecho a la libertad sindical y, por otro, la libertad de empresa y las facultades que ella concede al empresario. Todo esto además se produce en un contexto de máxima tensión legislativa, a la espera de que el Gobierno regule el trabajo en plataformas. Los intereses entre ambas partes, sindicato demandante, y la empresa demandada que se dedica al reparto de mercancía a través de plataformas digitales, son manifiestamente opuestos, pues los primeros apuestan por el reconocimiento de una relación laboral entre los riders y la empresa, mientras que la segunda apunta por el trabajo autónomo de éstos. This judgement is issued by the Spanish Supreme Court., where the scope of the right of association and the limits of the corporate activity is discussed. Specifically, the matter is if the business could communicate directly and unilaterally with its workers, or whether any type of meeting should be considerate an act that violate the right to freedom of association. In doing so, a balance of rights will be made among, on the one hand, the aforementioned right to freedom of association and, on the other, the freedom of enterprise and the power that it grants to the employer. The context is of maximum interest, where the Government was developing a regulation for the platform work.
