Abstract

Las nuevas formas de prestar servicios que aparecen con la era tecnológica provocan un claro desequilibrio a la hora de interpretar la actividad de las empresas que los prestan. Estas empresas, cuya función principal es servir de enlace entre el cliente y el prestador de servicios, desarrollan una actividad semejante a la de los prestadores tradicionales pero a través de trabajadores autónomos, lo que hace difícil determinar la sujeción a un marco normativo u otro. Se trata de encontrar un nuevo cauce que permita regular esta realidad tan diferente a la imperante en el momento en que se promulgaron las leyes. En este trabajo se pretende ofrecer un análisis, desde el punto de vista jurídico, de las carencias presentes y proponer un modelo regulatorio alternativo al actual.

The new ways of providing services that appear with the digital era, has caused an evident imbalance in the interpretation of their activity. These companies, whose main function is to serve as a connection between the client and the service provider, perform an activity similar to traditional providers but through self-employed workers, which makes it difficult to determine the subjection to a regulatory framework or another. It is a question of finding a new channel to regulate this reality so different from the moment our laws were enacted. This paper intends to prove an analysis, from the legal point of view, of the present deficiencies and propose an alternative regulatory model to the current one.
