Aplicación directa de las Directivas de contratación de 2014 ante su falta de transposición en plazo
Abstract
Antes del 18 de abril de 2016, los países de la Unión Europea tenían que transponer las siguientes tres directivas: La Directiva 2014/24/UE, sobre contratación pública, la Directiva 2014/23/UE, relativa a la adjudicación de contratos de concesión, la Directiva 2014/25/UE, relativa a la contratación por entidades que operan en los sectores del agua, la energía, los transportes y los servicios postales. Un año después de la fecha límite, España no ha transpuesto todavía las directivas a su derecho nacional. De acuerdo con el Tribunal Europeo de Justicia, las directivas pueden tener efecto directo. Organismos administrativos españoles han emitido normas de soft law sobre los efectos directos de las nuevas directivas de contratación pública. Y un organismo administrativo independiente, El Tribunal Administrativo Central de Recursos Contractuales, ha resuelto sobre recursos después de haberse superado la fecha límite para la transposición. Este Trabajo de Fin de Grado busca exponer cómo los organismos administrativos españoles han intentado evitar un posible impacto negativo en la contratación pública por la falta de transposición en plazo de esas directivas. By 18 April 2016, EU countries had to transpose the following three directives into national law: Directive 2014/24/EU on public procurement, Directive 2014/23/EU on the award of concession contracts and Directive 2014/25/EU on procurement by entities operating in the water, energy, transport and postal services sectors. A year after the deadline, Spain has not yet transposed the directives into national law. According to the ECJ, the directives may have direct effects. Spanish administrative bodies have issued soft law about the direct effects of the new public procurement directives. And independent administrative bodies, as the Public Procurement Review Central Administrative Court, have decided about reviews after the end of the deadline. This Final Degree Project seeks to expose how the Spanish administrative bodies have tried to avoid a possible negative impact on public procurement of not having transposed those directives on time.
