EL POSITIVISMO JURÍDICO Y SUS CRÍTICAS

Abstract

¿Es siempre compatible el positivismo jurídico con la justicia como dimensión valorativa del Derecho? ¿Cómo se ha criticado el positivismo jurídico a lo largo de la historia? En este trabajo se llevará a cabo un estudio del positivismo jurídico y sus críticas. Partiendo de la construcción del concepto del Derecho y su triple dimensión, es decir como hecho social, como norma y como valor, se llegará a los reduccionismos jurídicos, base sobre la que se han construido las distintas teorías del Derecho. El segundo bloque del trabajo consistirá en un estudio de las grandes teorías del Derecho, a partir de los conceptos de justicia, validez y eficacia. Tanto el iusnaturalismo como el realismo nos permitirán conocer de qué forma y porqué el positivismo se ha criticado.

¿Is legal positivism always compatible with justice as a dimension of law? ¿How has positivism been criticized along history? In this essay, a study of the legal positivism and its criticism will be made. Starting with the construction of a concept of law from a triple dimension, as a social fact, as a rule and as a value, we will arrive to the legal reductionisms, which are the base of the different law theories. The second part of the essay will consist of a study of these important theories from the concepts of justice, validity and legal effectiveness. Iusnaturalism and realism will allow us to know in what way and why positivism has been criticized.
