Estudio sobre la necesidad del reconocimiento de unos derechos que protejan la vida animal. ¿Pueden los animales seguir siendo entes cosificables?

Abstract

Históricamente, los animales han estado subordinados a la figura del ser humano sirviéndole como alimento, abrigo e incluso entretenimiento. La protección de tales animales no humanos siempre ha estado recubierta de polémica, motivada principalmente por el inmovilismo que ha presentado durante toda la historia el ser humano, ya fuese con la esclavitud antiguamente o con las mujeres más recientemente. Este trabajo pretende abordar la posibilidad de regular la protección animal en España, planteando las principales cuestiones que surgen al hablar de dicha protección. Se pretende analizar si la protección que merecen los animales no humanos debe ser una obligación nuestra o si por el contrario éstos deben ser sujetos de derecho como lo somos nosotros y gozar de un catálogo de derechos que les proteja frente a las injerencias del ser humano e incluso de otros animales. Así mismo se analizará lo que conllevaría para el ser humano dicha protección y si se limitará nuestro ámbito de actuación en pro de una protección animal. Finalmente se procederá a realizar un estudio sobre la normativa española así como la de países europeos que puedan servir de influencia a nuestra legislación teniendo en cuenta algunas de las fuertes tradiciones presentes en nuestro país.

Historically, animals have been subordinated to the figure of the human being, serving as food, shelter and even entertainment. The protection of such non-human animals has always been covered by controversy, motivated mainly by the immobility that has been presented throughout history by human beings, either with slavery formerly or with women rights more recently. This paper aims to address the possibility of regulating animal protection in Spain, raising the main issues that come out when talking about such protection. It seeks to analyse if the protection that non-human animals deserve should be our obligation or if on the other hand these animals should be subjects of law, as humans are, and enjoy a catalogue of rights that protect them against the interference of humans and even from other animals. It will also be analyse what would entail for human beings such protection and if our scope of action will be limited due to further animal protection. Finally, a study will be carried out on Spanish regulations as well as on the normative of other European countries to study how they might influence our legislation, taking into account some of the strong traditions present in our country.
