El significado político de las segundas Cámaras: el Senado en España ¿un valor para la democracia

Abstract

La opción bicameral actual de nuestras Cortes tiene un significado histórico pues es el modelo seguido por prácticamente todas las Constituciones históricas. En el artículo se analiza esta evolución hasta llegar a la Constitución de 1978 que define al Senado, en el artículo 69.1, como Cámara de representación territorial . El carácter territorial del Senado se manifiesta fundamentalmente en su composición, puesto que en las funciones que tiene encomendadas se desnaturaliza su sentido inicial. La reforma del Reglamento del Senado ha intentado paliar esa distorsión adoptando como vía para la especialización del Senado en los asuntos territoriales la creación de la Comisión General de las Comunidades Autónomas. Analizado que, tanto por su composición como por sus funciones, el Senado se presenta en nuestro sistema constitucional como una Cámara adormecida, surge desde un primer momento la necesidad de proceder a su reforma. El debate, tanto doctrinal como político, en el que existe consenso, versa especialmente en cuanto a su composición, pero creemos que sería importante también recoger una modificación en sus funciones que hagan posible, si no llegar a un bicameralismo paritario, sí al menos romper el bicameralismo imperfecto.

The present bicameral option of our Parliament has an historical meaning because it is the model followed by practically all the historical Constitutions. In the article this evolution is analyzed until arriving at Constitution of 1978 that it defines to the Senate, in article 69.1, like territorial representation Camera . The territorial character of the Senate is pronounced fundamentally in its composition, position that in the functions that it has entrusted denatures its initial sense. The reform of the Regulation of the Senate has tried to palliate that distortion adopting for the specialization of the Senate in the territorial subjects the creation of the Comisión General de Comunidades Autónomas . The debate, as much doctrinal as politician, in whom consensus exists, turns specially as far as its composition, but we think that it would be important also to gather a modification in its functions that make possible, if not to arrive at a partier bicameralism, less to break the imperfect bicameralism.
