Refugiados de facto. Relectura jurídica en el contexto internacional actual

Abstract

Las persecuciones de carácter político y social, los conflictos armados, así como los efectos provocados por el cambio climático, entre otras circunstancias, traen aparejadas situaciones de desplazamiento humano. Algunas de las personas forzadas al exilio, están protegidas por el Derecho Internacional de los Refugiados mientras que, otras, quedan sometidas a la discrecionalidad de sus Estados, pudiendo ser incluso devueltas a sus países de origen o de residencia habitual. Estas soportan situaciones de vulnerabilidad extrema al estar desamparadas, invisibilizadas, sin voz. Por tanto, es de imperiosa necesidad que los Estados pongan a la persona en el centro, amplíen su mirada y establezcan mecanismos jurídicos para salvaguardar a este colectivo.

Every political or social persecution, every armed conflict, as well as the side effects of the climate change -among other elements- tend to have as a consequence some human displacement situations. Most of these people forced to exile are protected by the International Refugee Law. Others are just exposed to the discretion of their States, taking the risk of being deported to their habitual residence countries or their own home countries. These are extreme vulnerable situations as those people are helpless, invisible, voiceless... Therefore, those States have the urgent need of giving priority to their people, open their vision and set up legal mechanisms in order to protect this social group.
