Protección internacional en la frontera Nador-Melilla : el caso de Sam

Abstract

Sam1 tuvo que huir de su país debido a la Guerra Civil que se inició en Siria en el año 2011, por temor a ser reclutado para combatir. Así mismo, el campamento de refugiados palestinos donde residía en Yarmuk, al sur de Damasco, fue totalmente bombardeado. Tras pasar por Argelia, solicita protección internacional en el puesto fronterizo de Melilla, donde su solicitud no fue admitida a trámite por deducir de su entrevista y posterior reexamen que proviene de un tercer país seguro (Argelia). La finalidad del presente trabajo de investigación es identificar desde una perspectiva formal y material, las deficiencias en el acceso a protección internacional en España, en concreto, en la frontera Melilla-Nador, a partir de un caso real. A la vista de la investigación realizada, se llega a la conclusión de que la tramitación de su solicitud partió de premisas falsas, habiéndose encontrado deficiencias importantes en la citada tramitación, y posterior denegación de la misma. La entrevista realizada a Sam revela la discrepancia entre la gestión que realizó la Administración española de su solicitud y las circunstancias concretas de su caso.

Sam had to run away from his country due to the civil war started in Syria in 2011, afraid of being recruited to fight. In the same way, the refugee campsite where he stayed in Yarmuk, in South Damascus, was totally bombed. After crossing Algeria, he asks for international protection at the border in Melilla, where his application form has not being accepted, considering his interview and the later review that he comes from a third safe country (Algeria). The purpose of this paperwork tries to identify from a formal and material perspective and, after the development of a research work, the deficiencies in the access to international protection in Spain, in particular, in the border of Melilla-Nador, starting from a real case. In the light of the many submissions made, we come up with the conclusion that the processing of his request has started from false premises besides to base his argumentation in concepts that in this case have no place, listing the deficiencies found in the development of his application and later denial.
