Aproximación juridico-ética a la gestación subrogada: regulación de la cuestión en España
Abstract
El negocio jurídico del contrato de gestación por sustitución es nulo de pleno derecho en nuestro ordenamiento jurídico en virtud del artículo 10.1 LTRHA. Sin embargo, esta condición no está impidiendo que, paulatinamente, el número de niños que nacen a través de esta técnica de reproducción asistida esté creciendo en detrimento de otros métodos más tradicionales. Esto ha originado numerosos debates jurisprudenciales y doctrinales, sobre todo en torno al reconocimiento internacional de las filiaciones procedentes de países donde el negocio se admite por el Derecho. Si bien sería adecuado la existencia de una regulación internacional, se aboga por una admisión en Derecho Español del mismo en virtud de la protección de la familia, la dignidad y libre desarrollo de la personalidad de los padres intencionales en materialización del principio de igualdad y de la libertad que les ampara, como principio superior del ordenamiento jurídico español. Se abordará el origen de esta figura jurídica, el concepto de gestación subrogada, así como sus clases, y un análisis de la cuestión en España. Asimismo, se abogará por un derecho a la procreación o a la maternidad y paternidad que debe poder verse realizado a través de esta figura. Principios como el altruismo, el interés superior del menor y un acceso a este tipo de contratos por parte de cualquier persona, soltera o con pareja -con limitaciones-, independientemente de su sexo, deben inspirar una muy esperada regulación por el status quo social y cultural. Se defiende que solo su reconocimiento respeta la dignidad de la madre gestante en cuanto poseedora de un derecho a autodeterminar su personalidad. The legal business of the surrogate motherhood contract is null and void under the Spanish legal system by virtue of the article 10.1 of the LTRHA. Nevertheless, this condition is not preventing the fact that, progressively, the number of children born thanks to this assisted reproduction technique is growing at the expense of other traditional methods. This has raised several case law and doctrine debates, especially on the subject of the international recognition of parenthood originated in countries where this contract is admitted under its law. Even though the existence of an international regulation of this legal business is recommended, an admission under the Spanish law of this contract is advocated by virtue of the families’ protection principle, the dignity of the human person and the free development of the personality, which protect the intentional parenthood as an embodiment of the equality principle, and the freedom that shelter them as a superior principle of the Spanish legal system. This thesis approaches the origin of this legal concept, the definition of surrogate motherhood as well as the types that exist, and an analysis of the matter in Spain. In addition, this thesis advocates that a right for procreation or parenthood should be fulfilled by means of this contract. Principles such as altruism, the superior interest of the child or an access to this contract by everybody, married or unmarried -with limitations-, regardless its gender, should inspire a highly expected regulation from the social and cultural status quo point of view. It is believed that only its recognition respects the dignity of the surrogate mother as an individual holder of the fundamental right to self-determine its personality.
