Libertad religiosa en España y Estados Unidos: el tratamiento constitucional de los símbolos religiosos
Resumen
El derecho de libertad religiosa nació de la mano de la democracia norteamericana en el momento de su independencia. En una sociedad caracterizada por el pluralismo religioso, la necesidad de regular las relaciones Iglesia-Estado hacen que Estados Unidos se coloque como pionero en este derecho. Por el contrario, en Europa, debido al pensamiento Ilustrado surgido en Francia y a las guerras de religión vividas en Europa, la libertad religiosa surge con una connotación negativa. Se pretende secularizar una sociedad eminentemente religiosa y por ello se combate directamente con la religión. La Primera Enmienda norteamericana recoge las dos clausulas religiosas “establishment clause” y “free exercise” en contraposición al artículo 16 de la Constitución española. Dos formas de regular el derecho de libertad religiosa que sin duda va a traer distintas consecuencias en la convivencia de la sociedad civil con las distintas confesiones religiosas. The right to religious freedom began with the American democracy at the time of its independence. In a society characterized by religious pluralism, the need to regulate Church-State relations makes the United States position itself as a pioneer in this right. On the contrary, in Europe, due to the enlightened thought that arose in France and the religious wars experienced in Europe, religious freedom arises with a negative connotation. The intent of secularizing an eminently religious society, is causing an open fight against religion. As opposed to article 16 of the Spanish Constitution, the First American Amendment includes the two religious clauses "establishment clause" and "free exercise". Two ways to regulate the right of religious freedom that will undoubtedly bring different consequences in the coexistence of civil society with different religious confessions.
