Comparativa de la figura del jurado en España y EEUU

Abstract

El Tribunal del Jurado es una figura presente en ordenamientos jurídicos de diversos países entre los que se encuentran España y Estados Unidos, si bien presentan diferencias tanto en su configuración como en su implantación a lo largo de la historia. Además, el Jurado en Estados Unidos goza de mucha más difusión debido, sobre todo, a la emisión de series de abogacía a nivel internacional. De esta forma se pretenden establecer los principales contrastes entre ambos países, especialmente, en cuanto al funcionamiento de esta institución, de manera que las diferencias se puedan advertir más fácilmente. Para ello, se recurre a la Ley Orgánica 5/1995 del Tribunal del Jurado donde se encuentran todas las normas reguladoras del mismo, en comparación con Estados Unidos donde la regulación depende en Estado en el que se encuentre el acusado. Así, se abordan cuestiones como la composición del mismo o el tipo de delito al que se aplica, además de otras materias más accesorias como la remuneración o sistema de selección.

Jury duty is a figure present in legal systems of different countries, including Spain and the United States of America, although they have both a distinct configuration and implementation throughout history. In addition, the Jury in the United States has a greater diffusion due, above all, to the broadcast of legal tv shows worldwide. In this way, this project tries to establish the main contrasts between both countries, especially talking about the functioning of this institution, so differences can be more easily noticed. To achieve it, it is used the Organic Law 5/1995 of the Jury Court, where all the regulation of the Jury appears, unlike the United States, where the operating rules depends on the State in which the defendant is located. Thus, this project addresses issues such as the composition of the Jury or the type of crimes to which it applies, as well as other incidental matters such as remuneration or the selection system.
