dc.description.abstract | La finalidad perseguida con la elaboración del presente trabajo es identificar las deficiencias que presenta el sistema fiscal español como consecuencia de la descentralización territorial vigente para poder determinar qué medidas son necesarias así como cuáles serían los puntos fundamentales de estas. El escenario definido por el análisis de los principios tributarios fundamentales se caracteriza por la falta de autonomía en la vertiente de los ingresos que genera un claro déficit de corresponsabilidad fiscal, la falta de solidez del sistema de coordinación ofreciendo la posibilidad de que avance el fraude y la doble imposición. Además, la intensa crítica que rodea al régimen foral abre el debate sobre si los métodos empleados para el cálculo de la financiación de estos territorios resultan adecuados y si los mismos contribuyen en suficiente medida como para entender cumplido el principio de solidaridad. A la situación planteada debe añadirse un contexto europeo marcado por la ausencia de una regulación tributaria específica donde la jurisprudencia se erige como pieza clave generando una cierta sensación de inseguridad jurídica. De este modo, se podría considerar el ISD como el caso perfecto para examinar los efectos del marco teórico definido en la realidad social al permitir combinar la problemática interna con la comunitario. | es-ES |
dc.description.abstract | The target pursued with the preparation of this paper is, to identify the deficiencies that the Spanish tax system presents as a consequence of the current territorial decentralization. This is done in order to determine what measures are necessary as well as what the fundamental points would be. The scenario defined by the analysis of the fundamental tax principles is characterized by the lack of autonomy in the revenue side. This generates a clear fiscal coresponsibility déficit. The lack of solidity of the coordination system offers the possibility of taking fraud and double taxation advantage. In addition, the intense criticism surrounding the regional government opens the debate on whether the methods used to calculate the finance of these territories are adequate. Also if they contribute enough to understand the principle of solidarity. A European context marked by the absence of a specific tax regulation where jurisprudence stands as a key element generating a certain sense of legal insecurity must be added to the situation raised. In this way, the ISD could be considered as the perfet case to examine the effects of the theoretical framework defined in the social reality by allowing the combination of internal and community problems. | en-GB |
