Problemas internos derivados de la aplicación de los convenios para evitar la doble imposición internacional en el derecho tributario español
Resumen
El mundo globalizado e interrelacionado en el que hemos desembocado gracias a las políticas inclusivas de las últimas décadas, a pesar de las numerosas ventajas que nos ha traído, también ha hecho que nos hayamos visto obligados a hacer frente a un problema fiscal que afecta a los individuos personalmente: la doble imposición fiscal internacional. En el momento en el que un sujeto pasivo realiza un hecho imponible está obligado a tributar por ello. Sin embargo, los sujetos pasivos para los cuales el estado de la fuente y el estado de residencia no son coincidentes han tenido que lidiar con problemas de doble imposición, ya que se les ha exigido tributar por ello en ambos estados. Para evitar esta doble tributación, se ha creado la figura de los Convenios de Doble Imposición, acuerdos bilaterales que buscan medidas para regular la tributación de los afectados, sin olvidar tampoco a los paraísos fiscales, que tratan de mantenerse a la sobra de la legalidad y de las nuevas figuras legales que buscan su desaparición, como los Tratados de Intercambio de Información. Lo que se busca en este trabajo es estudiar los principales elementos fiscales afectados, cómo se regulan de manera genérica por la OCDE, y cómo se aplican posteriormente de manera individualizada a tres ejemplos de convenios de doble imposición firmados por España: Con Alemania, país miembro de la UE desarrollado; con Lituania, país miembro de la UE en desarrollo, y con Japón, país no miembro de la UE desarrollado. The globalized and interrelated world in which we have led thanks to the inclusive policies of the recent decades, despite the numerous advantages that it has brought us, it has also made us face up to a fiscal problem that affects the individuals: the international double taxation. At the moment in which a person performs a taxable event, it is obliged to pay for it. However, the taxpayers for whom the state of the source and the state of residence are not coincident have had to deal with problems of double taxation, since they have been required to pay for it in both states. In order to avoid this situation, the figure of the Double Taxation Agreements has been created, which are bilateral agreements that seek measures to regulate the taxation of those affected, without forgetting tax havens, which try to stay on both the legality and the new legal figures that seek his disappearance shadows, like the Treaties of Exchange of Information. The aim of this paper is to study how the main fiscal elements are affected by double taxation and how they are treated in the avoidance of double taxation process, how they are regulated in a generic way by the OECD, and how they are subsequently applied individually into three examples of double taxation agreements signed by Spain: With Germany, a developed member country of the EU; with Lithuania, a developing member country of the EU, and with Japan, a developed non-member country of the EU.
