La responsabilidad civil en el ámbito del Derecho de familia

Abstract

La sociedad occidental viene experimentando desde mediados del siglo XX una acelerada transformación, impulsada por multitud de factores, que ha provocado profundos cambios en la forma de vida y los principios que regían el mundo hasta hace apenas 100 años. El Derecho, como síntoma que es de la sociedad de cada tiempo , no se ha mantenido ajeno a estas circunstancias, si bien es poco discutible que su transformación ha ido a un ritmo más paulatino que la del mundo que ordena y regula. El avance de la moral individualista, la priorización de la autonomía y la libertad privada, así como la emancipación de la mujer , entre otros, han alterado la institución familiar tanto en su estructura como en la cantidad y la rigidez de los derechos y obligaciones que la misma integra. Siguiendo la lógica anterior, el Derecho de Familia no se ha mantenido ajeno a estas alteraciones, y, entre otras muchas, ha sufrido una curiosa mutación en cuanto a la incidencia recibida respecto de la responsabilidad civil.

Since the middle of the twentieth century, multiple factors have been inducing an accelerated transformation of western society, causing deep changes in the lifestyle and values that governed the western world heretofore. Law, as a symptom of the society of each era1, has not been apart from these changes. Nevertheless, Law might have been a step behind the rhythm of these changes, for the most times following them and the fewer, triggering them. The preponderance of individual values, the prioritization of personal will and autonomy, as well as the emancipation of women2, between many other factors, have transformed the family as a social and legal institution. This transformation can be appreciated in its structure, not to mention the one suffered in the rights and obligations inherent to it. Following the previous logic, Family Law has not stood apart from these changes and, between other multiple modifications, it has experienced a curious mutation in the way it is linked with civil liability.
