dc.description.abstract | En el presente trabajo de investigación llevaremos a cabo un estudio sobre los distintos métodos de impugnación que se recogen en el derecho procesal, dentro de la Ley de Enjuiciamiento Civil. Analizaremos los distintos artículos dentro de la Ley, y diferenciaremos las distintas fases en las que se pueden llevar a cabo dichos métodos de impugnación. Además, profundizaremos en el recurso de apelación, siendo éste uno de los recursos fundamentales dentro del derecho procesal. Por un lado, analizaremos el marco teórico del mismo, haciendo una delimitación del ámbito del recurso, y estudiando la regulación del mismo. Posteriormente, comentaremos diversas cuestiones de notoria relevancia en relación con éste recurso, como el alcance de conocimiento del tribunal en segunda instancia; la modificación del objeto de recurso, conocida como mutatio libelli; y la impugnación de aquellas resoluciones judiciales que son favorables. Por último, haremos una serie de conclusiones en base al trabajo de investigación realizado. | es-ES |
dc.description.abstract | The objective of the present paper is to obtain a deeper understanding of the different alternatives that can be used to contest within the Spanish procedural law System. Therefore, we will thoroughly analyse the main Spanish law (Ley de Enjuiciamiento Civil) where these aspects are referred to, focusing on the different alternatives that arise throughout the phases that we find in the civil process. We will examine in detail the figure of the appeal being this recourse one of the most popular ones in the Spanish Procedural Law system. For this purpose, we will distinguish between the theoretical and the practical perspective that the appeal eligibility provides specially referred to the second instance moment within a civil litigation process. Furthermore, we will develop other matters that concern the appeal such as the mutatio libelli in order to enhance our knowledge about the aforementioned recourse. | en-GB |
