La regulación penal de la ciberdelincuencia y el uso de las TICS por parte de los terroristas

Abstract

El rápido desarrollo del progreso tecnológico y la dependencia de las sociedades a la tecnología, han ocasionado que ésta haya pasado a ser un elemento omnipresente en nuestra vida y que haya cambiado totalmente la forma que tenemos de relacionarnos socialmente. Sin embargo, a pesar de sus múltiples beneficios, estos avances tecnológicos también han traído consigo inconvenientes, en concreto uno de especial interés: la ciberdelincuencia y el ciberterrorismo. El ciberterrorismo, cuyo fin es provocar terror a la sociedad utilizando las tecnologías (TICs), con la intención, entre otras, de causar daños a las infraestructuras vitales de un Estado, supone hoy en día una de las mayores amenazas para nuestras sociedades, ya que la mayor parte de las infraestructuras de países occidentales y de Oriente Medio, tanto bursátiles, como financieros y bancarios, están formadas por sistemas informáticos y son, por tanto, dependientes del funcionamiento de dichos sistemas. Por tal motivo, en este texto he analizado las formas en las que los terroristas usan las TICs para llevar a cabo las conductas delictivas y las medidas que desde el Derecho Penal español se han adoptado para evitar que dichas conductas se lleven a cabo y que, en caso de darse, los ciberterroristas puedan ser perseguidos.

The rapid development of technological progress and the dependence of societies on technology have caused it to become an omnipresent element in our life and have totally changed the way we socially relate. However, despite its many benefits, these technological advances have also brought with them inconveniences, specifically one of particular interest: cybercrime and cyberterrorism. Cyberterrorism, whose aim is to terrorize society using technologies (ICTs), with the intention, among others, to cause damage to the vital infrastructure of a State, is today one of the greatest threats to our societies, since that most of the infrastructures of Western countries and the Middle East, both stock exchange, financial and banking, are formed by computer systems and are, therefore, dependent on the operation of such systems. For this reason, in this text I have analyzed the ways in which terrorists use ICTs to carry out criminal behavior and the measures that have been adopted by Spanish Criminal Law to prevent such behaviors from being carried out and that, In case of occurrence, cyberterrorists can be persecuted.
