Se trata de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, por la que se transponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014, la cual incorpora y positiviza la jurisprudencia que el Tribunal de Justicia de las Comunidades Europeas realizó antes de la elaboración de las Directivas europeas que recogen los requisitos y condiciones aplicables a los medios propios. Se analiza tanto jurisprudencia como doctrina administrativa autorizada y estudiosa de la materia a la vez que se expone la utilización, evolución y desarrollo de la figura, haciendo una comparativa entre la normativa anterior y la actual para poder responder a las preguntas de cómo funcionan, para qué sirven, cómo se regulan, cuáles son los nuevos requisitos para configurarse como medio propio y si su uso se ajusta o no a la libertad del mercado en materia de contratación pública por la incidencia que tienen los encargos a medios propios en el Derecho de la Competencia. This project will comment the new regulation of the figure in house providing in light of the reform of the Public Sector Contract Law.
