La administración de justicia y desigualdad en EE.UU.

Abstract

En este trabajo analizamos el contexto socioeconómico de Estados Unidos, así como la compatibilidad de su modelo de Derechos y Libertades con la doctrina capitalista presente en el país. Para hacerlo, nos planteamos la siguiente hipótesis: ¿Es el capitalismo implementado por Estados Unidos un sistema compatible con la garantía de protección de los Derechos Fundamentales y acceso a la Justicia por parte de los ciudadanos? De cara a responder esta hipótesis, en primer lugar, estudiamos los orígenes del país y los valores que cimentaron su rápido crecimiento. Tratamos entender cuales han sido los factores que han configurado la sociedad norteamericana y la evolución que estos han experimentado conforme han ido interactuado con las ideologías y políticas presentes en el país. En segundo lugar, entramos en profundidad en el estudio de la Constitución y la Bill of Rights (Carta de Derechos), centrándonos en los Derechos relativos a protección de la tutela judicial efectiva, la separación de poderes y los principales actores del Poder Judicial. En tercer lugar, ponemos en perspectiva los Derechos y Libertades garantizados en los documentos anteriormente nombrados con la situación actual del país. Nos encontramos ante un estado con una pobre distribución de riqueza y enormes desigualdades entre clases que, sirviendo al propósito de una doctrina capitalista pura, parece haber dejado en segundo plano los ideales de libertad, igualdad e individualismo sobre los que se fundó.

In this Project we are going to analyze de socioeconomic context of the United States, as well as the compatibility of it regime of Rights & Freedoms with the capitalist doctrine settled in the country. In order to do so, we would like to lay out the following hypothesis: Is capitalism, as it is understood in the United States, a viable system when opposed to the Rights & Freedoms regime in terms of access to the Judicial System? In order to answer that question, we are going to: Firstly, analyze and study the nation´s history, and the principles that fostered it´s fast growth. Furthermore, we asses to understand and point-out the agents that set up the American society and the evolution that they have had while dealing with constant change in American´s ideology and politics. Secondly, we will research the United States Constitution and the Bill of Rights, focusing on the Rights involving the right to a fair trial and due process, the separation of powers and the main actors of the Judicial branch. Finally, we will put into perspective the Rights & Freedoms guaranteed in both, the Constitution and the Bill of Rights, with the current situation in the country. We find ourselves in a country with a very unequal distribution of wealth and gigantic inequalities among social classes that, following the path of pure capitalism, has set aside the values of liberty, equality and individualism over it was founded on.
