EL IMPUESTO DE SUCESIONES Y DONACIONES. COMPARATIVA AUTONÓMICA.
Resumen
Este trabajo trata acerca de la situación actual en la que se encuentra el Impuesto de Sucesiones y Donaciones en España, el cual se ha visto afectado por la cesión de competencias que se produjo en el año 1996 a las Comunidades Autónomas. Como consecuencia de la misma, se han producido enormes desigualdades en lo que han los sujetos en función de si el causante tenía su residencia habitual en una u otra Comunidad.
Además, las tendencias actuales de las Comunidades Autónomas por bonificar casi el 100% del impuesto han levantado ciertas voces a favor de la supresión del mismo en tanto que deja de cumplir con la función redistributiva que el mismo tenía en el momento en el que se creó. Por todo ello, es necesario estudiar si realmente existen tales diferencias y cuáles podrían ser las soluciones para paliarlas. This paper deals with the current situation in which the Inheritance and Donations Tax is found in Spain, which has been affected by the cession of powers that occurred in 1996 to the Autonomous Communities. As a consequence of this, there have been enormous inequalities in what the subjects have in terms of whether the deceased had his habitual residence in one or the other Community.
In addition, the current trends of the Autonomous Communities for reducing almost 100% of the tax have raised certain voices in favor of its suppression, as long as it fails to comply with the redistributive function that it had at the time it was created. . Therefore, it is necessary to study if there really are such differences and what could be the solutions to alleviate them.
