¿Por qué no se han cumplido las cuotas de ubicación de refugiados previstas en el Consejo de la Unión Europea de 2015? : análisis de las dificultades, problemas y el futuro de los refugiados en el marco de la Unión Europea

Abstract

El objetivo del presente trabajo es analizar las dificultades y problemas que ha habido en el marco de la Unión Europea en relación con las cuotas de refugiados y por qué hemos llegado al plazo establecido sin que se hayan reubicado a estas personas. Así, se hará una pequeña introducción que analice la evolución de las distintas estrategias de la Unión Europea, hasta llegar al sistema de cuotas, remontándonos a 2015. Más tarde, se hará un análisis de la responsabilidad acarreada por los Estados miembros por el incumplimiento del compromiso y del resultado de estas cuotas de reubicación por cada uno de ellos. Después, se analizará la responsabilidad de la Unión Europea, las deficiencias del Sistema Común de Asilo como respuesta a la crisis de refugiados y la nueva propuesta del Reglamento de Dublín IV, teniendo en cuenta las distintas posiciones de la Comisión, el Parlamento Europeo y el Consejo. Finalmente, se concluirá respondiendo a la pregunta inicial, aludiendo a la que se considera razón principal del incumplimiento del sistema de cuotas por los Estados miembros.

The main aim of this paper is to analyze the difficulties and problems that have been within the framework of the European Union in relation to refugee quotas and why we have reached the established term without having relocated these people. In this regard, a brief introduction will be made to analyze the evolution of the strategic alternatives of the European Union until reaching the quota system, going back to 2015. Later, make an analysis of the responsibility of the United States for the breach of the commitment and the result of these relocation fees for each of them. Afterwards, the responsibility of the European Union, the deficiencies of the Common Asylum System in response to the refugee crisis and the new proposal for the Dublin IV Regulation will be analyzed, taking into account the possible positions of the Commission, the European Parliament and the Council of Europe. Finally, it will be concluded by answering the initial question, deciphering what has been the main reason for the breach of the quota system by the Member States.
