La desheredación en el Código civil

Abstract

En el presente trabajo vamos a realizar un estudio sobre la institución jurídica de la desheredación. Procederemos a analizar, desde las disposiciones legales, la opinión doctrinal y la jurisprudencia, existente sus distintos elementos así como, principalmente, las causas que llevan a ella y que pueden afectar de manera específica tanto a los descendientes, a los ascendientes y al cónyuge. Terminaremos nuestra exposición abordando las posibles consecuencias que la desheredación puede llevar consigo para los legitimarios y con una apartado dedicado a presentar las conclusiones de nuestra investigación.

In the present essay, we are going to carry out a study on the legal institution of disinheritance. We will proceed to analyze, from the legal dispositions, the doctrinal opinion and the jurisprudence, existing its different elements as well as, mainly, the causes that lead to it and that can affect in a specific way both the descendants, the ancestors and the spouse. We will finish our presentation by addressing the possible consequences that disinheritance can bring with it for the legitimation and with a section devoted to presenting the conclusions of our research.
