Instrumentos prácticos de la abogacía. Metodología y argumentación jurídica

Abstract

Básicamente argumentar implica dar razones en favor de una decisión, para buscar la aceptación de una tesis o postura frente a un asunto determinado. En definitiva, probar por medio de razonamientos alguna afirmación. Partiendo de este concepto se puede entender que la argumentación jurídica es una disciplina que estudia los razonamientos propios de los profesionales del Derecho, comprendiendo tanto a los órganos del Estado encargados de la creación del Derecho, de la interpretación, como de la aplicación.

Basically the argumentation involves giving reasons in favor of a decision, to seek acceptance of a thesis or position in front of a particular issue. In short, prove by means of reasoning some affirmation. Starting from this concept it is possible to be understood that the legal argumentation is a discipline that studies the reasonings proper to the professionals of the Law, understanding as much to the organs of the State in charge of the creation of the Right, of the interpretation, as of the application.
