La LECRIM establece que debe ser el juez de instrucción quien determine la edad del presunto menor investigado por un delito. A lo largo de este artículo se pretende analizar si a la luz de la Convención de los Derechos del Niño, y en especial de acuerdo al interés superior del menor, debe ser el juez de instrucción quien deba proceder a la determinación de la edad, o bien debe ser la jurisdicción de menores, sobre quien recaiga dicha decisión, aplicando así la Ley de Responsabilidad Penal del Menor. The Criminal Procedure Act establishes that the age assessment of the alleged minor suspect of a crime must be determined by the investigating judge. Throughout this article, we intend to analyze whether, in the light of the Convention on the Rights of the Child, and especially in accordance with the best interests of the child, the investigating judge must proceed to determine the age, or it must be the jurisdiction of minors, on whom the decision falls, applying the Law of Criminal Responsibility of Minors.
